4.1.1 Purpose

This regulation establishes the roles, responsibilities, accountability and authorities of all shore staff of company, and all crewmembers of managed vessels for smooth implementation and operation of the EMS.

4.1.2 Scope

This procedure shall apply to all persons in company offices and on-board vessels to which the EMS is applicable. It is required that the persons concerned should perform the work regarding the system on the basis of their roles, responsibilities and authorities.

4.1.3 Organization

In order to fulfill the EMS requirements and to ensure continuous improvement in Company’s environmental performance the MD/ DPA has constituted continuous review through HSSEQ. The Department TD along with the leadership of the Top Management shall be the implementers.

4.1.4 Role & Responsibility

Responsibility for environmental management is distributed through the various levels of the organization as described in various procedures of SMS.

4.1.5 Personal Accountabilities

  • a) Accountability ensures that there is a relationship between an employee’s performance of her/his environmental responsibilities and her/his overall performance evaluation. Company’s accountability system will inform personnel, principally through performance evaluations, of the importance the Company places on environmental quality and compliance. Appropriate disciplinary actions, ranging from remedial training to termination, will be taken for employees who fail to perform their environmental compliance responsibilities.
  • b) All Company employees whether on board fleet vessels or ashore shall be personally responsible for ensuring that they undertake their tasks in a manner consistent with the Environmental Policy and objectives.
  • c) All Company shipboard staff is required to sign the following:Upon reaching any conclusive evidence of misconduct and irregular practices pertaining to environmental protection by shipboard staff, the management has defined following consequences:
    1. CRW-01A Declaration of Environmental Commitment prior to joining a fleet vessel at the manning office to re-affirm their understanding of regulatory requirements and their commitment towards compliance. In case for any reason it was not done prior joining, it should be signed on boar immediately upon joining.
    2. Upon completion of the tour of duty each crewmember shall sign CRV-18 Declaration of Environmental Compliance to declare strict adherence to EMS manual procedures and applicable laws during the service period onboard.
  • d) If a crew member signs off due to unforeseen circumstances and the declaration of compliance is not executed by the crew member, the Master shall then do so on his behalf and document the reason(s) why the crew member was unable to do so.

4.1.6 Result of Non-Compliance

Upon reaching any conclusive evidence of misconduct and irregular practices pertaining to environmental protection by shipboard staff, the management has defined following consequences:

  • (i) Termination of employment
  • (ii) Liability for criminal/ civil and administrative penalties that may be imposed as a result of non-compliance

4.1.7 MARPOL Non-Compliance Reporting

  • a) A channel of communication has been established by company for all Crew to report any observed violation or infringement or intention thereof towards MARPOL requirements.
  • b) Such reporting shall be made to DPA/ MD
  • c) It is to be noted that this channel is restricted to reporting only MARPOL violations only and shall not be used for any other operational or personnel grievances which is to be as per procedures laid out in SMS.
  • d) Please note that the company will not disclose name of crew who reports such violation onboard to the company and will protect him/her/them accordingly.
  • e) Kindly ensure (as much as possible) your reporting is accurate with factual evidence, timeline of events, name and rank of crew violating, and any photographic or document evidence for Top Management to conduct a proper investigation and support.

4.1.8 Incentive Programs

  • a) Company shall integrate environmental management as a reward, incentive and discipline element within performance appraisal process of each crew. Such incentive program shall include the following elements:
  • (i) Whenever a crew member reports a situation that may have been a potential spill or threat to environment, he shall be awarded a citation / recommendation letter.
  • (ii) If any spill occurs on board, the crew reporting it well in time to avoid damage to environment shall receive a commendation letter or other reward from the company while considering his overall contribution in the activity to preserve environment.

4.1.9 Subcontractors and Consultants

  • a) The Environmental Management on board should ensure that all work undertaken by subcontractors and consultants...
  • b) Masters shall ensure that Subcontractors visiting onboard undergo Contractor Safety Familiarization HSSEQ-14.
  • c) A copy of the Company environmental policy shall be provided to such parties for their information...

4.1.10 Delegation

Responsibilities as defined in the EMS Policy Manual or Environmental Management Plans may be delegated provided the nominated person is suitably qualified to assume the responsibility and that the delegation is in writing.
